      1. How Hotel Cashback works

    At hotelcashback.co.uk (our “Site”) we aim to use our expertise in the travel and online marketing industries to bring you the best offers for Hotel and travel bookings.
    We want to make the process as simple as possible so that you can find the service which best suits your travel needs and earn a cashback reward for every booking you make through our site.

    How does the cashback process work?
    Hotel Cashback carefully selects offers from Hotel and Travel Companies which we think will be of interest to you. We then act as an advertiser for these selected retailers by telling you about their offers and directing you to their website. In return for sending them customers, the retailers (and their tracking agenices) pay us commission. We then pass on this commision to you as “Cashback”. This Cashback will initially be added to your account with “pending” status. Once all checks relating to the payment have been successfully completed and the retailer has confirmed that the transaction has not been cancelled or refunded, the cashback will be “confirmed” become “payable” to you. At this point you will be able to request a payment of your Cashback by your preferred method in the “Payments” section of your Hotel Cashback account.

        1. Registering for a Hotel Cashback Account and Terms of Use

      For the Cashback process to work you need to become a member of Hotel Cashback. In doing so, you must confirm that you agree to accept the following terms, if you do not agree to these terms, you must not use our Site. You must also read our and agree to our “Privacy Policy” which details how we collect, process and use the data you provide us with. It is your responsibilty to ensure that all data provided by you is accurate and correct. This may include, where requested, your correct name, address, and any other requested details. If you are asked for, and provide, details of a bank account, Paypal account, credit card or other account into which you wish to receive payments (your “Cashback Payment Method”), you (a) must ensure that you are, and remain, fully entitled to use that Cashback Payment Method, (b) confirm that you wish to receive Cashback through that Cashback Payment Method, and (c) ensure that the details of that Cashback Payment Method are, and continue to be, accurate. You should keep this information updated through your Account.

      It is important to ensure that the email address we hold for you is kept up-to-date and that you have full access to it – we will be sending you important messages there. If you change email address, then you must change the address we hold for you on your Account.

      To obtain a Hotel Cashback account you must be at least 16 years of age. Only one account is allowed per person.  Duplicate or multiple accounts are not allowed and users found to be using linked or duplicate accounts may have there account suspended and/or blocked.

      We understand that on occassions you will want to make bookings on behalf of other family members or close friends. This will be subject at all times to fair usage and one account should not be used to make purchases on behalf of many other people. The legal owner of the email address used to sign up to the Site is deemed to be the account owner. Any Cashback earned by a third party using the account will be credited to the account as if you had made the transaction yourself.

      We reserve the right to refuse membership and or suspend or terminate any account in accordance with these terms of use.

      It is completely free to become a member of Hotel Cashback and no membership fee will be deducted from your Cashback at any time.

          1. Important Information to note about the Cashback Process

        Firstly we must draw to your attention that the transactions you make are directly with the retailer, not Hotel Cashback. When you make a purchase via the Site with a retailer, it is tracked using cookies and various other technologies which allow the retailer to identify that a purchase has been made, who made it and where it came from. Once the retailer or tracking network has identified the purchase and acknowledged it, it will show up in your account as ‘pending’. When the retailer validates the purchase it may show in your account as ‘confirmed’. Once we have received the commission from the retailer, it will then show up in your account as ‘payable’ (“Payable Cashback”). You are then free to withdraw your money by any of the methods offered in Payments section of your account, in accordance with any payout terms and conditions applicable at the time of payout.

        To ensure your Cashback tracks successfully and the process runs smoothly it is important to follow these steps:

        3.1 Ensure you have correctly logged in to your Hotel Cashback account before clicking on any retailer links, otherwise any purchases you make will not be tracked back to your account. You should also disable any Adblocker plugins or extensions in your browser. These may block the tracking scripts that our site and the retailer’s tracking networks use to track purchases and award cashback. Without these tracking scripts, the we would not be able to accurately track purchases and award cashback.

        3.2 When you are ready to make your booking or purchase, click on the “Get Cashback” button on our site to be taken to your chosen retailer. Clicking through to a retailer via any other link or a sponsored advert, or navigating directly to the retailer website will not activate the tracking process and no commission will be received by us, and you will therefore not receive any Cashback for the transaction.

        3.3 After you click the “Get Cashback” button you must proceed to complete your purchase or booking with the retailer in the window which has opened as a result of your clicking on this button. Navigating away from our Site to a third party, failing to complete your transaction in full at the time of clicking from our site, navigating directly to the retailer or delaying the completion of your purchase may result in the transaction failing to track to your account.

        3.4 All purchases must be genuine. Repeat purchases may not qualify for Cashback and you must purchase for genuine reasons. By making a transaction via the Site you acknowledge that it is at the retailer’s entire discretion to determine whether a transaction is genuine and you acknowledge that we will not be liable for any Cashback where a retailer has deemed a transaction disingenuous.  We reserve the right to suspend Payable Cashback payments at any time without notice to you if we reasonably suspect fraudulent activity has taken place and the accounts of any users suspected of carrying out fraudulent transactions will be permanently blocked.

        3.5 After you make your purchase we will receive notification from the retailer or their tracking network that a transaction has been tracked directly back your Hotel Cashback account by an identifying tag. If you are not logged in to your Hotel Cashback account when you make your purchase, or have not properly followed the steps above regarding how to complete the Cashback process, there will be no identifying tag matching you with the transaction taking place and no cashback will be allocated to you for the sale.

        3.6 The retailer or their tracking network will notify us that your purchase is a “qualifying transaction”. As explained above, whether or not a purchase is a qualifying transaction is entirely at the discretion of the retailer and you acknowledge that we will not be liable for any Cashback to you if the retailer does not accept your transaction as a qualifying transaction.

        3.7 Cashback may be declined if all or part of your order is returned, amended or cancelled. This is is entirely at the discretion of the retailer and you acknowledge that we will not be liable for any Cashback if you or the retailer cancels or amends your order or the order is refunded.

        3.8 To receive your cashback your account must be valid and active. If your account is terminated, suspended or disabled for any reason, then any Cashback payable will be deemed to be forfeited.

        You acknowledge and agree that in order for this process to work, we and the affiliate networks need to track and confirm your purchase and it is therefore necessary for the affiliate networks to share the order ID relating to your purchase with us.

        In the case that a genuine transaction has not been automatically tracked to your account, we ask you to notify us of this by filling in the appropriate “Missing Cashback” claim form in the Help Section of our website. We will use reasonable endeavors to investigate such Claims with the retailer or tracking agency subject always to our right to cease investigations at any point at our entire discretion.

        You acknowledge that the retailer and/or it’s tracking agency’s decision is final in relation to the payment of commission to us and in turn, our decision is final in relation to paying Cashback to you. We will make all reasonable endeavors to secure the payment of commission on a transaction but we do not and cannot make any guarantee in this regard. In the event we do not receive the expected commission for a transaction for whatever reason, we will not be liable to pay the relevant Cashback to you.

        We reserve the right to reclaim or adjust any Cashback payments in the event that any Cashback has been paid to you in error. This may include but not be limited to transactions where Cashback is not genuinely due to you or where any commission for a transaction has not been received from a retailer or its agencies but been paid over to you as Cashback in error.

        It is important to note that we do not hold money in your account similar to a bank. A Cashback Balance in you Hotel Cashback Account does not itself represent a sum of money held by Hotel Cashback on an Account Holder’s behalf. Legal title to any cashback earnings does not pass to you until you have taken possession of the cashback by way of a successful withdrawal from your Hotel Cashback account.

        For the avoidance of doubt and notwithstanding any other provision contained in these terms and conditions, you agree and acknowledge that in all circumstances the payment of Cashback to you is at our discretion and we may refuse to pay Cashback to you for any reason.

            1. Requesting Payment of your Cashback

          You can submit a request to withdraw any Payable Cashback from your account at any time by clicking the “Request Payment” button on your account page.

          You may withdraw your Payable Cashback from your account by Bank Transfer, Paypal or various other giftcard and voucher providers. Payout methods may stipulate a minimum value threshold being reached before allowing you to withdraw your Payable Cashback. You should always check the terms of each payout method before withdrawing your Payable Cashback.

          It is your responsibility to ensure your correct payout details are submitted. You will be asked to confirm these details as part of the Payment Request Process. We shall not be responsible for any Payable Cashback being sent to an incorrect destination where you have provided incorrect details. Such payments may not be recoverable and or may be subject to a recovery fee.

          The time between requesting payment of your Payable Cashback and it being credited to your chosen payout method may vary. We shall not be liable for any delays in this regard or for any consequences of any delays which may occur.

          We reserve the right to suspend Payable Cashback payments at any time without notice to you if we reasonably suspect fraudulent activity has taken place.

              1. Keeping you Details Up-to-Date

            It is your responsibility to ensure you keep your account up to date with your current email address to make sure you don’t miss out on any important information about your account. If we don’t have a serviceable email address or if you mark our emails as spam, junk or abusive, we may terminate your account.

                1. Cancelling your Account and Account Terminations

              If for any reason you wish to cancel your account, you can do so at any time by following the instructions found in the Help Section of our Site.

              In the event of fraudulent, abusive or other activity we determine to be unfair, we reserve the right to terminate your account.

              Please note that accounts may be disabled if they are deemed at our discretion to be dormant. In order to keep your account active, you are required to log into your account least once every 6 months (although you are not required to make any purchase).

                1. Cashback Bonuses

                Sign-Up Bonus: Your sign-up bonus will initially show in your earnings as “pending” when you sign up to Hotel Cashback.  When you reach the “threshold” amount of eligible confirmed cashback your bonus will become payable.  This threshold is currently £10.00 but is subject to change.  If this amount changes at a later date, your bonus will become payable when your confirmed earnings reach the threshold as advertised at the time you opened your account.  Please note that Cashback bonuses (such as sign-up and refer-a-friend bonuses) do not count towards this minimum level of confirmed cashback earnings.  The sign-up bonus is available for new users only.  Duplicate or multiple accounts will not be accepted and will not be eligible for any bonus. 

                 Refer-a-friend (Referral Scheme) :  Referral bonuses are intended to help new members discover our site and to reward you for telling your friends about us. The Hotel Cashback referral bonus amount may increase or decrease at any time. When the referral bonus amount has changed, you will be eligible to receive the amount that was advertised on the site at the time your friend signed up from your link, which may be different to the amount offered when you sent the link to your friend or when the bonus was applied to your account.  Your refer-a-friend bonus will initially show in your earnings as “pending” when your friend signs up to Hotel Cashback using your referral link.  When they reach the “threshold” amount of eligible confirmed cashback your bonus will become payable.  This threshold is currently £10.00 but is subject to change.  If this amount changes at a later date, your bonus will become payable when your friend’s confirmed earnings reach the threshold as advertised at the time they opened their account.  Please note that Cashback bonuses (such as sign-up and refer-a-friend bonuses) do not count towards this minimum level of confirmed cashback earnings.

                    1. Site Suspension or Withdrawal

                  We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

                      1. Changes to Terms

                    We may amend these terms from time to time to reflect changes to our members’ needs and our business priorities. Every time you wish to use our Site, please check these terms to ensure you understand the terms that apply at that time. The Terms can be accessed at any time following the link shown on the bottom of all pages of our Site.

                        1. Your Responsibilities

                      Any password or other such piece of information you choose or are provided with as part of our security procedures must be treated as confidential. You must not disclose it to any third party.
                      For fraud prevention purposes, any password or security information you choose must be unique for your Hotel Cashback account.

                      We have the right to disable any password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

                      If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us via the Contact form found in the Help Section of the Site.

                          1. Fraud Prevention

                        We operate systems on the Site to deter and limit any fraudulent use or abuse of the Site and reserve the right to apply any fraud prevention measures as we see fit.

                        We reserve the right to investigate any transactions that you make on the Site which may include the passing of your personal data to third parties who we work with in the provision of providing Cashback. Such data transfers are explained in more detail in our Privacy Policy. If, at our sole discretion we deem that abuse or suspect any fraudulent use of any offer on the Site has occurred we reserve the right to terminate your account and you shall forfeit any earnings contained within it.

                            1. Inaccuracies in Information Displayed on our Site

                          The content on our Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Site.

                          From time to time retailers may increase or decrease the commission paid in which case the cashback offer illustrated on our site may be incorrect. Although we make reasonable efforts to update the information on our Site in a prompt manner, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

                              1. Our Responsibility

                            We will exercise reasonable care and skill in performing our obligations to you but we do not guarantee that the Site will meet your requirements.

                            Hotel Cashback is not a party to any transactions with retailers, and is not the seller or supplier of, and does not endorse, any of the goods or services that they make available. Thus we do not have any of the legal obligations that apply to the sellers of those goods or services.

                            Accordingly, we have no control over or responsibility for:

                            the quality, safety, or legality of the goods or services available from retailers; or
                            whether the retailer can or will supply and pass good title to any goods or services.

                            Account Holders should exercise no lesser degree of caution in entering into transactions with retailers than they would when entering into a similar transaction elsewhere.

                            We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

                            Subject to this clause, we do not accept any responsibility or liability for any loss or damage you may incur:

                            - for any loss of revenue, business, anticipated savings or profits;
                            - any indirect, special or consequential loss, damage or other claims, howsoever caused or arising;
                            - resulting from any transaction via the Site with any retailer;
                            - in connection with the accuracy or content of any reviews of products or services displayed on our Site or on any other website that you may access via our Site;
                            - arising from an inability to access our Site, from any use of the Site or from reliance on the data transmitted using the Site where such losses or damages are caused by any event beyond our reasonable control including as a result of the nature of electronic transmission of data over the internet;
                            - in connection with any voucher codes that you obtain via our Site.

                            Where we are found to be liable to you, our total liability (regardless of how many claims are brought) shall be shall be limited to £5 (five pounds sterling).

                            Except as expressly stated elsewhere in these terms, all representations, warranties, conditions and other terms whether express or implied are hereby excluded to the fullest extent permitted by law.

                                1. Indemnity

                              You agree upon demand to indemnify Hotel Cashback against and to be wholly responsible for all liabilities, claims and expenses that may arise out of or in connection with (a) any breach of this Agreement by you or through your Account, or (b) any transaction with a retailer.

                                  1. Uploading reviews and comments to our Site

                                Any comments or reviews that you post on our Site will be considered non-confidential and non-proprietary. You retain all your ownership rights in your content, but you are required to grant us and other users of our Site a limited licence to use, store and copy that content and to distribute and make it available to third parties.

                                We have the right to disclose your identity to any third party who is claiming that any content posted by you to our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

                                It is each Account Holder’s obligation to ensure that any material posted by him/her or associated with his/her Account:

                                - is not defamatory, offensive, or abusive or of an obscene, indecent or menacing nature;
                                - is not intended or likely to cause needless annoyance, inconvenience or distress to any person;
                                - does not contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data or personal information;
                                - does not contravene any applicable law or regulation (including, but not limited to, laws governing consumer protection, distance selling, unfair competition, anti-discrimination, false advertising, copyright, trademark and privacy);
                                - does not breach the rights of any person or entity (including any rights or expectations of privacy);
                                - where it constitutes feedback on a retailer, is accurate and fair; and
                                - does not advertise any goods or services.

                                We have the right to remove any posting you make on our Site if, in our opinion, your post does not comply with these content standards.

                                    1. Virus Protection Measures

                                  We do not warrant or guarantee that our site will be secure or free from bugs or viruses and shall not be held liable for any loss, damage or disruption you may suffer whilst using material derived from the Site.

                                  You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.

                                  You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

                                      1. Linking to Our Site

                                    You may link to our Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

                                    You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

                                    Our Site must not be framed on any other site.

                                    We reserve the right to withdraw linking permission without notice.

                                    You must not link a site to us which we may deem at our sole discretion to be inappropriate, contain explicit material, immoral or offensive.

                                    You must not redirect other domain names to our Site.

                                        1. Content of Websites Linked to by our Site

                                      We are not responsible for websites we link to.

                                      Where our Site contains links to other sites and resources provided by third parties, these links are provided for your information and as service to you. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

                                      We have no control over the contents of those sites or resources. By listing or linking to another site, we are not making any kind of endorsement and we accept no liability in respect of content. We do not guarantee that links will work all of the time and cannot control the availability of the linked pages.

                                      If you deem any link inappropriate or offensive, or find any link not working, please let us know at so we can remove the link.

                                          1. Unauthorised use of our Site

                                        If it is found that our Site is being tampered with in any way including but not limited to modification of any URL’s, posting unauthorized URL’s on public media, pages being spidered, email cloaking, automatic scripts or anything deemed by us to be abnormal use, then we may terminate your account without prior notice and any earnings shall be forfeited by you.

                                            1. Miscellaneous

                                          Any failure by us to enforce any of our rights or obligations set out within these terms will not constitute a waiver of our rights to subsequently enforce such provision or any other provision of these terms.

                                          If any part of these terms and conditions is determined to be invalid or unenforceable then such provision shall be deemed to be superseded by a valid and enforceable provision that most closely matches the intent of the original provision and the remainder of these terms shall continue to apply.

                                          Please note that all communications (including formal notices) under this Agreement are to be sent and received by email. For this purpose, your notices should be sent via our contact form to be found in our Help Section, and we will send our notices to you at the email address you notify us to use when you register as an Account Holder, as changed subsequently in your Account details.
